Terms of Service

By using our Service, you consent to receive newsletters, marketing communications, promotional content, and other updates we may send. You can, however, choose to stop receiving some or all of these communications at any time by clicking the unsubscribe link or by emailing us at support@campaignstudio.in.

If you choose to buy any product or service offered through our Service (“Purchase”), you may need to provide specific information relevant to the transaction, including, but not limited to, your credit or debit card number, card expiration date, billing address, and shipping details.

You confirm and guarantee that: (i) you are authorized to use any payment card or method provided for any Purchase, and (ii) the information you submit to us is accurate, current, and complete.

We may utilize third-party services to process payments and finalize Purchases. By sharing your information, you authorize us to pass this information to these third parties, consistent with our Privacy Policy.

We hold the right to decline or cancel your order at any point for reasons such as, but not limited to, product or service availability, errors in product or service descriptions or pricing, inaccuracies in your order, or other reasons.

We also reserve the right to decline or cancel your order if there is suspicion of fraud or unauthorized or unlawful activity.

Any contests, sweepstakes, or other promotional events (collectively referred to as "Promotions") provided through the Service may have rules that differ from these Terms of Service. If you choose to take part in any Promotions, we encourage you to review the relevant rules and our Privacy Policy. In the event that the rules of a Promotion conflict with these Terms of Service, the rules for the Promotion will take precedence.

Certain aspects of the Service are charged on a subscription basis ("Subscription(s)"). You will be invoiced ahead of time on a recurring and regular schedule ("Billing Cycle"). The length of billing cycles will be determined based on the subscription plan you choose when signing up for a Subscription.

At the conclusion of each Billing Cycle, your Subscription will renew automatically under the same terms unless you cancel it or CampaignStudio Digital Media Pvt. Ltd. cancels it. You have the option to cancel your Subscription renewal either through your online account management page or by reaching out to support@campaignstudio.in.

To process your subscription payment, a valid payment method is required. You must provide CampaignStudio Digital Media Pvt. Ltd. with accurate and complete billing details, which may include, but are not limited to, full name, address, state, postal or zip code, phone number, and valid payment method information. By submitting such payment details, you grant CampaignStudio Digital Media Pvt. Ltd. permission to charge all Subscription fees accrued through your account to the provided payment method.

If automatic billing fails for any reason, CampaignStudio Digital Media Pvt. Ltd. reserves the right to immediately revoke your access to the Service.

CampaignStudio Digital Media Pvt. Ltd. may, at its discretion, provide a subscription with a free trial for a limited duration ("free trial").

When signing up for a free trial, you are not required to provide billing or card information, and you will not be charged by CampaignStudio Digital Media Pvt. Ltd. until you choose to upgrade to a paid subscription during or after the trial period ends. On the final day of the free trial, unless you select a paid subscription, your account will be automatically deactivated.

At any point and without prior notice, CampaignStudio Digital Media Pvt. Ltd. reserves the right to (i) alter the terms of the free trial offer, or (ii) discontinue the free trial offer altogether.

CampaignStudio, at its sole discretion, may adjust Subscription fees for any Subscriptions at any time. Any changes to the Subscription fees will take effect at the conclusion of the current Billing Cycle.

CampaignStudio will provide you with reasonable advance notice of any Subscription fee changes, giving you the opportunity to cancel your Subscription before the new fees are applied.

By continuing to use the Service after the Subscription fee change takes effect, you agree to pay the updated Subscription fee.

Refunds (either partial or full) will not be provided once the subscription has begun. To avoid further charges, you may cancel your subscription before its end date.

Our Annual, Half-Yearly, and Quarterly commitment plans offer a lower monthly rate compared to our month-to-month plans in exchange for a fixed commitment to our service. Customers who wish to cancel their committed plan early may incur a cancellation fee. The fee is calculated based on the total savings you have received at the discounted rate.

Here’s how we calculate the fee: [List Price] - [Month-to-month rate of your plan] = Monthly savings amount. [Monthly savings amount] x [Number of months used] = Cancellation fee (plus tax, if applicable).

Our Service enables you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content you share on or through the Service, including ensuring its legality, reliability, and appropriateness.

By posting Content on or through the Service, you represent and warrant that: (i) the Content is yours (you own it) and/or you have the right to use it and grant us the rights and license as described in these Terms, and (ii) posting your Content on or through the Service does not infringe upon the privacy, publicity, copyrights, contract rights, or any other rights of any person or entity. We reserve the right to terminate the account of anyone found infringing upon copyright.

You retain all rights to any Content you submit, post, or display on or through the Service, and you are responsible for protecting those rights. We do not assume any responsibility or liability for Content posted by you or any third party on or through the Service.

CampaignStudio Digital Media Pvt. Ltd. reserves the right, but is not obligated, to monitor and edit any Content provided by users.

Additionally, Content available on or through this Service is the property of CampaignStudio Digital Media Pvt. Ltd. or is used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or otherwise use such Content, in whole or in part, for commercial purposes or personal gain without express prior written consent from us.

You may use the Service strictly for lawful purposes and in alignment with these Terms. You agree not to use the Service in the following ways:

0.1. In violation of any applicable local, national, or international laws or regulations.

0.2. To exploit or harm minors, including exposing them to inappropriate content.

0.3. To send or facilitate unsolicited promotional materials, such as “junk mail,” “chain letters,” “spam,” or similar solicitations.

0.5. In any way that infringes on others' rights, or is illegal, threatening, fraudulent, harmful, or connected to any unlawful or fraudulent activity.

0.6. To engage in any conduct that limits or restricts another’s use or enjoyment of the Service or may, as determined by us, harm or offend the Company, its users, or expose them to liability.

0.7. To send unsolicited emails to recipients who have not opted in to receive them.

Furthermore, you agree not to:

0.1. Use the Service in any manner that could disable, overburden, damage, or impair it, or interfere with others' use, including real-time interactions.

0.2. Use automated systems, like robots or spiders, to access the Service for any reason, including monitoring or copying material on the Service.

0.3. Use manual processes to monitor or copy material on the Service, or for any unauthorized purpose, without prior written consent.

0.4. Deploy any device, software, or routine that disrupts the proper functioning of the Service.

0.5. Introduce viruses, trojans, worms, logic bombs, or any other malicious or technologically harmful material.

0.6. Attempt unauthorized access, interfere with, damage, or disrupt any part of the Service, its server, or any associated server, computer, or database.

0.7. Attack the Service through a denial-of-service or distributed denial-of-service attack.

0.8. Take actions that could damage or manipulate the Company’s rating.

0.9. Attempt to interfere with the proper functioning of the Service in any other way.

Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using Service, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of Service.

By creating an account with us, you confirm that you are over 18 years old and that the information you provide is always accurate, complete, and up-to-date. Providing inaccurate, incomplete, or outdated information may lead to the immediate termination of your account on the Service.

You are responsible for keeping your account and password confidential, including limiting access to your computer or account. You accept responsibility for any actions or activities that occur under your account or password, whether the password is associated with our Service or a third-party service. You must promptly notify us of any security breaches or unauthorized use of your account.

Your username cannot be the name of someone else, a name not legally available for use, or a name or trademark owned by another person or entity without proper authorization. Additionally, you may not use a username that is offensive, vulgar, or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

The Service, along with its original content (excluding user-provided content), features, and functionality, shall remain the exclusive property of CampaignStudio Digital Media Pvt Ltd and its licensors. The Service is protected by copyright, trademark, and other applicable laws of both domestic and international jurisdictions. Our trademarks may not be used in connection with any product or service without the prior written consent of CampaignStudio Digital Media Pvt Ltd.

We honor the intellectual property rights of others and have a clear policy to address any claims that Content posted on the Service violates the copyright or other intellectual property rights ("Infringement") of any individual or entity.

If you are the copyright owner or authorized representative of the owner, and you believe that your copyrighted work has been reproduced in a manner that constitutes infringement, kindly send your claim via email to support@campaignstudio.in, with the subject line: "Copyright Infringement." Please provide a detailed description of the alleged infringement as outlined in the "the Copyright Act, 1957 and Copyright Rules, 2013" section below.

Please be aware that you may be held liable for damages, including legal costs and court’s fees, for any false claims or bad-faith allegations regarding copyright infringement of Content on or through the Service.

You may provide us with information and feedback regarding errors, suggestions for improvements, ideas, problems, complaints, or any other matters related to our Service ("Feedback") either directly at support@mailmodo.com or through third-party sites and tools. By providing Feedback, you acknowledge and agree to the following: (i) you will not retain, acquire, or assert any intellectual property rights or other interests in the Feedback; (ii) the Company may have development ideas that are similar to your Feedback; (iii) the Feedback does not contain confidential or proprietary information belonging to you or any third party; and (iv) the Company has no confidentiality obligation regarding the Feedback. In the event that transferring ownership of the Feedback is not feasible due to applicable mandatory laws, you grant the Company and its affiliates an exclusive, transferable, irrevocable, royalty-free, sublicensable, unlimited, and perpetual right to use, including the ability to copy, modify, create derivative works, publish, distribute, and commercialize, the Feedback for any purpose and in any manner.

Our Service may include links to external websites or services that are not under the ownership or control of CampaignStudio Digital Media Pvt. Ltd.

CampaignStudio Digital Media Pvt. Ltd. does not control, and is not responsible for, the content, privacy policies, or practices of these third-party websites or services. We make no guarantees regarding the offerings of these third parties or their websites.

YOU ACKNOWLEDGE AND AGREE THAT CAMPAIGNSTUDIO DIGITAL MEDIA PVT. LTD. WILL NOT BE HELD LIABLE, EITHER DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS THAT MAY RESULT FROM OR BE ALLEGEDLY CAUSED BY YOUR USE OF OR RELIANCE ON ANY CONTENT, PRODUCTS, OR SERVICES PROVIDED BY SUCH THIRD-PARTY WEBSITES OR SERVICES.

WE STRONGLY RECOMMEND THAT YOU REVIEW THE TERMS OF SERVICE AND PRIVACY POLICIES OF ANY THIRD-PARTY WEBSITES OR SERVICES YOU VISIT.

THE SERVICES PROVIDED BY CampaignStudio Digital Media Pvt. Ltd. ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CampaignStudio Digital Media Pvt. Ltd. MAKES NO EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES REGARDING THE OPERATION OF THE SERVICES OR THE INFORMATION, CONTENT, OR MATERIALS CONTAINED THEREIN. YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THESE SERVICES, INCLUDING THEIR CONTENT AND ANY SERVICES OR ITEMS OBTAINED FROM CampaignStudio Digital Media Pvt. Ltd., IS AT YOUR OWN RISK.

NEITHER CampaignStudio Digital Media Pvt. Ltd. NOR ANY PERSON ASSOCIATED WITH CampaignStudio Digital Media Pvt. Ltd. MAKES ANY WARRANTIES OR REPRESENTATIONS ABOUT THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES. WITHOUT LIMITING THE ABOVE, NEITHER CampaignStudio Digital Media Pvt. Ltd. NOR ANYONE ASSOCIATED WITH CampaignStudio Digital Media Pvt. Ltd. GUARANTEES THAT THE SERVICES, THEIR CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED; THAT DEFECTS WILL BE CORRECTED; THAT THE SERVICES OR THE SERVER HOSTING THEM ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT THE SERVICES WILL MEET YOUR NEEDS OR EXPECTATIONS.

CampaignStudio Digital Media Pvt. Ltd. DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

EXCEPT AS PROHIBITED BY LAW, YOU AGREE TO HOLD HARMLESS CAMPAIGNSTUDIO DIGITAL MEDIA PVT. LTD. AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING IN ANY WAY (INCLUDING ATTORNEYS’ FEES AND ALL ASSOCIATED COSTS AND EXPENSES RELATED TO LITIGATION OR ARBITRATION, OR DURING TRIAL OR APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INITIATED), WHETHER IN A CONTRACT ACTION, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR IN CONNECTION WITH THIS AGREEMENT. THIS INCLUDES CLAIMS FOR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM THIS AGREEMENT AND ANY VIOLATION BY YOU OF ANY APPLICABLE FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF CAMPAIGNSTUDIO DIGITAL MEDIA PVT. LTD. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

EXCEPT AS PROHIBITED BY LAW, IF CAMPAIGNSTUDIO DIGITAL MEDIA PVT. LTD. IS FOUND LIABLE, THE LIABILITY WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL CONSEQUENTIAL OR PUNITIVE DAMAGES BE AWARDED. PLEASE NOTE THAT SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

CampaignStudio Digital Media Pvt. Ltd. reserves the right to terminate or suspend your account and restrict access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason, including, but not limited to, a violation of these Terms.

If you wish to terminate your account, you may do so simply by discontinuing your use of the Service.

Any provisions of these Terms that, by their nature, should survive termination shall remain in effect after termination, including, but not limited to, ownership rights, warranty disclaimers, indemnity clauses, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of India, and any disputes arising from this agreement shall be subject to the jurisdiction of the courts in India, without regard to its conflict of law provisions.

If we fail to enforce any right or provision of these Terms, it will not be deemed as a waiver of those rights. If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect. These Terms represent the entire agreement between the parties with respect to the use of the Service and supersede any prior agreements between the parties regarding the Service.

Service Agreement

All services provided by CampaignStudio Digital Media Pvt. Ltd. may only be used for lawful purposes. Transmission or storage of any data, material, or information that violates any laws of India, whether at the national, state, or local level, is prohibited. This includes, but is not limited to: copyrighted content, threatening or obscene materials, or any data protected by trade secrets or other statutes. The subscriber agrees to indemnify and hold harmless CampaignStudio Digital Media Pvt. Ltd. from any claims resulting from the use of the Service that causes damage to the subscriber or any other party.

Sending unsolicited emails, commonly known as spam, using an email address or URL hosted by CampaignStudio Digital Media Pvt. Ltd. or directing traffic to a webpage containing references to CampaignStudio Digital Media Pvt. Ltd. is STRICTLY prohibited. CampaignStudio Digital Media Pvt. Ltd. will be the sole judge of whether a violation has occurred. Such violations will result in the immediate termination of your account without refund. Any service interruptions caused by spamming will be billed to the subscriber at ₹3,750 per hour until service is restored. The subscriber may also face legal actions for violating the Service Agreement.

Using purchased leads in any manner with a CampaignStudio Digital Media Pvt. Ltd. account is strictly prohibited. If you have paid for or acquired pre-existing leads, these cannot be used on the platform. This includes co-registration services, "safe lists", or free leads. Only individuals who have directly requested information from you may be contacted through the Service.

Any attempts to automate the addition of new subscribers via scripting or batch processes, such as auto-submitting forms, are strictly forbidden. A script should never be used to subscribe a visitor to a list on their behalf. Only the visitor who wishes to subscribe should activate the subscription process.

Individuals under the age of sixteen (16) are prohibited from using the Services, providing personal information to CampaignStudio Digital Media Pvt. Ltd., or submitting such information through the Services.

Pornography or sexually explicit material is prohibited on any servers of CampaignStudio Digital Media Pvt. Ltd. The Company will decide at its sole discretion what constitutes a violation of this policy.

The collection of sensitive personal data such as racial or ethnic origin, political opinions, religious beliefs, trade-union membership, genetic or biometric data for the purpose of identifying a person, health-related data, or data concerning a person's sex life or sexual orientation is prohibited. CampaignStudio Digital Media Pvt. Ltd. will be the sole arbiter of violations related to this provision.

The subscriber acknowledges that the Company reserves the right to delete all data, files, or information stored in the subscriber's account if the account is terminated, whether by CampaignStudio Digital Media Pvt. Ltd. or the subscriber. System accounts cannot be transferred and are solely for the use of the registered subscriber. Any violation of this policy will lead to immediate account termination.

CampaignStudio Digital Media Pvt. Ltd. has the right to suspend a subscriber’s service at any time and for any reason, without prior notice. If such suspension lasts for more than 20 days, the subscriber will be notified of the reason.

Services provided by CampaignStudio Digital Media Pvt. Ltd. can be canceled in writing at any time without penalty. Cancellation requests must include the Customer Account Login/Email and the Response to the Security Question. Cancellation will only take effect once CampaignStudio Digital Media Pvt. Ltd. confirms receipt of the cancellation request. The Company reserves the right to modify rates by notifying the subscriber 15 days before the change takes effect.

CampaignStudio Digital Media Pvt. Ltd. exercises no control over the content passing through its platform. All leads (email addresses) generated by subscribers are kept strictly confidential and are not shared with third parties. The lead information is only used on CampaignStudio Digital Media Pvt. Ltd.’s servers to deliver the follow-up messages requested by the subscriber.

Customers are prohibited from transmitting unlawful, obscene, threatening, abusive, libelous, or hateful material via any of CampaignStudio Digital Media Pvt. Ltd.’s services. Any material that promotes illegal activity or violates any local, national, or international law is also prohibited.

Changes To Service
CampaignStudio Digital Media Pvt. Ltd. reserves the right to withdraw or modify the Service, or any material provided, at its sole discretion without notice. The Company will not be liable if the Service, or any part of it, is unavailable at any time or for any period. Access to certain parts of the Service may be restricted from time to time, including to registered users.

Amendments To Terms
CampaignStudio Digital Media Pvt. Ltd. may amend these Terms at any time by posting the revised terms on this site. It is the subscriber's responsibility to review these Terms periodically.

By continuing to use the Service after the revised Terms are posted, you agree to be bound by the changes. If you do not agree with the revised Terms, you are no longer authorized to use the Service.

Waiver and Severability
No waiver by CampaignStudio Digital Media Pvt. Ltd. of any term or condition set forth in the Terms shall be deemed a further or continuing waiver of such term or condition, nor a waiver of any other term or condition. If any provision is held to be invalid, illegal, or unenforceable, it shall be limited to the minimum extent necessary, while the remaining provisions shall remain in full force and effect.

Acknowledgement
By using the Service, you acknowledge that you have read these Terms of Service and agree to be bound by them.
